Rivers State Commission Of Inquiry Strikes Out Petition For Lack Of Proper Prosecution
The Rivers State Judicial Commission of Inquiry, which resumed sitting on Tuesday, 5 January, 2021, has struck out a petition following the absence of the petitioner and his counsel at the commission hearing.
The Chairman of the commission, Honourable Justice U.I. Uriri (retd), struck out the petition by HRH (Dr) luke Ineriene for lack of diligent prosecution.
When the matter was called,both the petitioner and his counsel were absent, but the counsel representing the police, I.N. Ubulom, was at the commission.
The counsel to the police said that their absence showed they had abandoned the case.
The counsel to the commission, S.O. Inko-Tariah, suggested that the matter be struck out for lack of diligent prosec ution.
The commission also struck out another petition brought by Ebiye Goodheasd for lack of diligent prosecution.
Both the petitioner and his legal representative were absent at the commission when the case was called.
The counsel representing the police,I.N. Ubulom, had applied to the commission to strike out the petition following their absence.
The commission’s counsel, Barrister S.O. Inko-Tariah,also agreed that the the petition be struck out.

In another case, the commission foreclosed the defence for being unprepared when a petition was called for defence and had fixed the matter for for conference.
The petition was by Magdalene Chinyere Amadi whose husband has been in police custody.
When the matter was called, the petitioner was present as well as her counsel, Yab Odi Fubara.
The counsel representing the police, I.N. Ubulom, was also at the commission but was unprepared for defence. He had asked for adjournment but was turned down by the commission.
The counsel to the petitioner asked the commission to foreclose the case since the defence counsel was unprepared.
He told the commission that the petitioner’s husband was in police custody.
