Ferry Gberegbe: Court Adjourns For Final Oral Address

Judgement will soon be delivered on suit filed by widow of late Dr Ferry Gberegbe as Port-Harcourt High Court adjourned sitting on Friday for adoption of final oral address.

The prosecuting and defence counsel would present final oral address on 12 February, before presiding judge, Justice Adolphus Enebeli, and will use it as final legal argument on the case and thereafter date for judgement.

Ronke  Gberegbe, widow of Dr Gberegbe, filed fundamental rights suit against  Commissioner of Police in Rivers State and  the then Commander of Special Anti-Robbery Squad (SARS), for allegedly violating right to life of her late husband.

 Dr Gberegbe was allegedly shot by officers of SARS on 10 March, 2019 at Independent   National Electoral Commission  Collation Centre in Bori in Khana Local Government Area of Rivers State.  Dr Gberegbe reportedly died in hospital where he was taken for urgent medical attention. He was on duty as collation agent of the ruling People’s Democratic Party in the year’s Governorship and House of Assembly elections.

Plaintiff and widow of Dr Gberegbe has asked for N800 million damages, her lawyer Lezina Amegua says, for alleged violation of the right to life of her late husband.

First defendant, the Commissioner of Police, and the second defendant, Akin Fakorede, have denied the allegation through their lawyer Essien Edet.

The plaintiff’s counsel later joined Police Service Commission as party in the suit after court had granted his application to join Police Service Commission.

He said in an interview that he was sure Dr Gberegbe was shot by security operatives.

A video clip allegedly showing how Dr Gberegbe was shot was played in courtroom in an earlier sitting.

The deceased who was lecturer at the Ken Saro Wiwa Polytechnic in Bori was buried in his hometown at the weekend. State governor, Chief Nyesom Wike, was at the funeral.
